First Offense DUI Defense in Atlanta
Former-Judge Insight for Your First Atlanta DUI Charge
A first DUI arrest can trigger two separate proceedings: a criminal prosecution and an administrative license matter. We address both from the outset, identifying immediate deadlines and preparing a defense based on the evidence surrounding the stop, arrest, and chemical testing.
Wakhisi-Douglas provides first-offense DUI defense in Atlanta with the perspective of a firm founded by a former judge in 2010. That judicial insight shapes how we evaluate legal issues, prepare motions, and anticipate the prosecution’s case. We also bring an excellent record at trial to matters requiring courtroom advocacy, although every case depends on its specific facts and evidence.
Protect your time to respond. Call (762) 722-0248 to discuss the charge and the separate process affecting your driving privileges.
What Happens After a First DUI Arrest in Atlanta?
After booking and release, a person charged with DUI generally receives a court date and must respond to the criminal accusation. Depending on where the arrest occurred, the case may proceed through Atlanta Municipal Court or the appropriate state court. The process can include arraignment, evidence review, motion practice, negotiations, and trial preparation.
The Georgia Department of Driver Services handles the administrative license suspension process separately from the criminal court. This civil action affects driving privileges but doesn’t determine guilt on the DUI charge. A driver generally has 30 days after an arrest in Georgia to request an administrative hearing, subject to the notice and circumstances involved.
Immediate Investigation & Evidence Preservation
Retaining counsel promptly allows us to assess the hearing deadline and request a hearing when appropriate. We can also seek to preserve dashcam and body-camera footage, review available officer training records, and document the officer’s account while events are still recent. Evidence may become harder to obtain over time, making early action important.
We evaluate the criminal case and the driver’s license matter separately while considering how evidence from the arrest affects each proceeding. A decision or deadline in one doesn’t automatically resolve the other.
Potential Penalties for a First Georgia DUI
A first DUI conviction in Georgia is a misdemeanor. The sentence can include a fine of $300 to $1,000 and 10 days to 12 months in jail. When the blood alcohol concentration was 0.08% or higher, the court may suspend all but 24 hours of the jail term, depending on the applicable law and circumstances.
Other consequences associated with a first conviction include:
- At least 40 hours of community service
- 12 months of probation, reduced by any time served in jail
- A 12-month driver’s license suspension
Drivers age 21 or older may be eligible to apply for reinstatement after 120 days by completing a DUI Risk Reduction Program and paying the required fee. Eligibility and driving consequences can depend on the driver’s record, chemical-test issues, and the status of the administrative case.
