Murder Charges Under Georgia Law

Georgia’s approach to murder differs from many states. Under O.C.G.A. § 16-5-1, the two charges that arise in most murder prosecutions are malice murder and felony murder, and both carry the same mandatory minimum: life in prison.

Malice murder requires intent to kill or conduct showing implied malice through extreme recklessness. Felony murder applies when a death occurs during the commission of a dangerous felony, even without intent to kill. Both charges are eligible for the death penalty when statutory aggravating circumstances are present.

Related charges carry their own serious consequences:

  • Voluntary manslaughter (O.C.G.A. § 16-5-2): An intentional killing in the heat of sudden passion from serious provocation. Carries up to 20 years in prison.
  • Involuntary manslaughter (O.C.G.A. § 16-5-3): An unintentional killing caused by unlawful conduct. When charged as a felony, penalties range from 1 to 10 years; when the underlying act was lawful but performed in an unlawful manner, the offense is punishable as a misdemeanor.

Georgia’s Seven Deadly Sins statutes apply to murder and certain other violent felonies, imposing mandatory minimums that can’t be probated, suspended, or served on parole. In some cases, prosecutors also pursue Gang Act enhancements, which can increase penalties even when a defendant has no actual gang affiliation.

  • Contesting felony murder: Challenging the underlying felony or arguing that death wasn’t a foreseeable result of the charged conduct.
