Standard misdemeanors in Georgia carry a maximum sentence of 12 months in jail and fines up to $1,000, but statutory surcharges for things like jail construction and peace officer training can increase the out-of-pocket cost by 40–50%, making a $1,000 fine closer to $1,500. 

Furthermore, Georgia recognizes a category called High and Aggravated Misdemeanors, which includes offenses such as aggressive driving, battery, or certain repeat violations. These carry fines up to $5,000 and significantly limit “good time” credits in jail, which can increase the actual time served.

Pre-Trial Diversion and the First Offender Act

Upon successful completion, charges may be dismissed, and the client’s record can be restricted or expunged. Under the First Offender Act, courts are required to order the restriction and sealing of records at the time of sentencing, protecting the client’s record while on probation rather than waiting until the program is completed.
